Attachment protection account certificate

The garnishment protection account (also often called a P-account) offers protection against account seizures in three stages:

  • Basic protection for balances up to €1,555.00
    Prerequisite: Conversion request submitted by the account holder to their bank
  • Increased allowance with certificate for alimony / social or asylum seeker benefits, for other persons in the household / child benefit / some other benefits
    Prerequisite: Presentation of a so-called P-account certificate by the account holder at their bank
  • Individually determined allowance with decision/noticefor higher income and special cases
    Therefore, prerequisite: Application with supporting documents to enforcement court/enforcement authority

To convert a checking account into a garnishment-protected account (P-account), the account holder simply needs to submit a request to their bank. The P-account then protects a balance of €1,555 per calendar month from garnishment and offsetting. Additional amounts can also be released upon presentation of proof.

Incidentally, only in special cases is a court decision or, in the case of public creditors, a decision by the enforcing authority required.

In this way, earned income, pensions and social benefits are protected in the same way as, for example, financial support from third parties.

If your account is seized, you still have full access to the account up to the amount of your protected allowance and can make transfers, for example.

Certificate of failure of the attempt to reach an agreement

Certificate of failure of an out-of-court settlement attempt pursuant to section 305 InsO

Before an insolvency petition can be filed, we offer your creditors a settlement. If the settlement is accepted by your creditors, we will have reached an out-of-court settlement and you will not have to file for insolvency.

If your creditors refuse, we can confirm the failure of the attempt to reach an agreement in writing as a recognized debtor advisory service in accordance with Section 305 (1) No. 1 InsO. You will therefore receive the required certificate and thus the basis for your insolvency application directly from us.
